Terms of Service – Shareable Listings

Welcome to Shareable Listings
By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.

1. Platform Overview

Shareable Listings is a real estate media sharing platform that allows listing agents to upload listing-related media and allows subscribing agents to download and share that media under a limited license.
The Platform does not claim ownership of any listing media uploaded by users.

2. User Types

The Platform supports two types of users:

A. Listing Agents (Uploaders)
Agents who upload listing media.

B. Subscribing Agents (Subscribers)
Agents who download and share listing media pursuant to the license granted herein.

    3. Intellectual Property Ownership

    All listing media uploaded to the Platform remains the intellectual property of the original listing agent and/or their brokerage.
    Shareable Listings does not acquire ownership of any uploaded content.
    Ownership of listing media is not transferred to subscribing agents.

    4. License Grant to Subscribers

    By uploading media to the Platform, Listing Agents grant Subscribing Agents a limited, non-exclusive, revocable, non-transferable license to download and share the media for:

    • Social media marketing
    • Client communications
    • General promotional purposes
      This license is subject to strict compliance with these Terms.
      The license does not permit modification of media beyond standard resizing or formatting for platform use.

    5. Attribution Requirement

    Subscribers are required to clearly credit the listing agent by including the listing agent’s full first and last name in any caption, description, or accompanying text when sharing media.
    Acceptable examples:

    •  “Listed by John Smith”
    • “Property courtesy of John Smith”
    • “Listing by John Smith”
      Failure to provide proper attribution constitutes a violation of these Terms.

    6. Prohibited Conduct

    • Subscribers may not:
      Represent, imply, or state that a property shown in downloaded media is their own listing unless they are the listing agent of record.
    • Use language such as “My new listing,” “Just listed by me,” or similar phrasing unless they are the actual listing agent.
    • Remove watermarks or identifying information.
    • Modify content in a way that misrepresents the property.
    • Resell, sublicense, or redistribute media outside of permitted uses.
      Listing Agents may not upload media they do not own or have authorization to share.

    7. Revocation of License

    Shareable Listings reserves the right to revoke a Subscriber’s license at any time for violation of these Terms.
    Upon revocation, the Subscriber must immediately cease use of all downloaded media.

    8. Account Suspension or Termination

    • We reserve the right to suspend or terminate accounts that:
       Violate attribution rules
    • Misrepresent listings
    • Infringe intellectual property rights
    • Engage in fraudulent or deceptive conduct
      Termination may occur without prior notice in cases of serious violations.

    9. Content Removal

    We reserve the right to remove any content that:

    • Violates these Terms
    • Is subject to ownership dispute
    • Is misleading or inaccurate
    • Exposes the Platform to legal risk

    10. No Brokerage Relationship

    Shareable Listings is not a brokerage and does not participate in real estate transactions.
    The Platform does not verify listing accuracy and is not responsible for property information.
    All transactions and representations are solely between agents and their clients.

    11. Disclaimer of Warranties

    The Platform is provided “as is” without warranties of any kind.
    We do not guarantee:

    • Accuracy of listing information
    • Continued availability of media
    • Suitability for any specific purpose

      Users assume full responsibility for their use of content.

    12. Limitation of Liability

    To the fullest extent permitted by law, Shareable Listings shall not be liable for:

    • Indirect or consequential damages
    • Loss of business or commissions
    • Disputes between agents
    • Claims arising from misuse of content

      Total liability shall not exceed the amount paid by the user in the preceding 12 months.

    13. Indemnification

    Users agree to indemnify and hold harmless Shareable Listings from any claims arising from:

    • Misuse of media
    • Misrepresentation of listings
    • Intellectual property disputes
    • Violation of these Terms

    14. Subscription & Payment

    Subscriptions are billed according to the selected plan.
    Fees are non-refundable except as required by law.
    We reserve the right to modify pricing with notice.

    15. Modifications to Terms

    We may update these Terms at any time.
    Continued use of the Platform after updates constitutes acceptance of revised Terms.

    16. Disclaimer of Warranties

    These Terms shall be governed by the laws of the State of California.
    Any disputes shall be resolved in the courts located in Los Angeles, CA.
